PREAMBLE
The Seller creates high-end fashion products and services for consumers, marketed through its websites (https://lapiece-paris.fr ). The list and description of the goods and services offered by the Company can be viewed on the aforementioned websites.
Article 1: Purpose These General Terms and Conditions of Sale determine the rights and obligations of the parties in connection with the online sale of Products offered by the Seller.
Article 2: General provisions These General Terms and Conditions of Sale (GTCS) apply to all sales of Products made through the Company's websites, which form an integral part of the Contract between the Buyer and the Seller. The Seller reserves the right to modify these terms at any time by publishing a new version on its website. The applicable GTCS are those in force on the date of payment (or the first payment in the case of multiple payments) for the order. These GTCS can be viewed on the Company's website at the following address: www.lapiece-paris.fr . The Company also ensures that their acceptance is clear and unconditional by providing a checkbox and a validation click. The Customer declares that they have read all of these General Terms and Conditions of Sale and, where applicable, the Special Terms and Conditions of Sale relating to a product or service, and accepts them without restriction or reservation. The Customer acknowledges that they have received the advice and information necessary to ensure that the offer meets their needs. The Customer declares that they are legally capable of entering into a contract under French law or are validly representing the individual or legal entity on whose behalf they are entering into the commitment. Unless proven otherwise, the information recorded by the Company constitutes proof of all transactions.
Article 3: Prices The prices of products sold through the websites are stated in euros excluding taxes and are precisely specified on the Product description pages. They are also stated in euros including all taxes (VAT + any other applicable taxes) on the product order page, excluding specific shipping costs. For all products shipped outside the European Union and/or the French overseas departments and territories, the price is automatically calculated excluding taxes on the invoice. Customs duties or other local taxes, import duties or government taxes may be payable in certain cases. These duties and amounts do not fall within the Seller's responsibility. They shall be borne by the Buyer and are the Buyer's responsibility (declarations, payment to the competent authorities, etc.). The Seller therefore invites the Buyer to obtain information on these matters from the relevant local authorities. The Company reserves the right to modify its prices at any time for future orders. Telecommunication costs required to access the Company's websites shall be borne by the Customer. Where applicable, delivery costs shall also be borne by the Customer.
Article 4: Conclusion of the contract online The Customer must follow a series of steps specific to each Product offered by the Seller in order to place an order. However, the steps described below are systematic: - Information on the essential characteristics of the Product; - Selection of the Product, where applicable its options, and entry of the Customer's essential details (identification, address, etc.); - Acceptance of these General Terms and Conditions of Sale. - Verification of the order details and, where applicable, correction of errors. - Following the payment instructions and paying for the products. - Delivery of the products. The Customer will then receive confirmation by email of payment for the order, as well as an acknowledgment of receipt confirming the order. For delivered products, delivery will be made to the address indicated by the Customer. For the proper completion of the order, and in accordance with Article 1316-1 of the Civil Code, the Customer undertakes to provide truthful identification details. The Seller reserves the right to refuse the order, for example in the event of an abnormal request, a request made in bad faith or for any legitimate reason.
Article 5: Products and services The essential characteristics of the goods and services and their respective prices are made available to the Buyer on the Company's websites. The Customer confirms having received details of the delivery costs as well as the payment, delivery and performance terms of the contract. The Seller undertakes to fulfill the Customer's order only within the limits of available Product stock. Otherwise, the Seller will inform the Customer. This contractual information is presented in detail and in French. In accordance with French law, it is summarized and confirmed when the order is validated. The parties agree that illustrations or photographs of the products offered for sale have no contractual value. The period of validity of the Product offer and their prices is specified on the Company's websites, as is the minimum term of the proposed contracts when they concern the continuous or periodic supply of products or services. Unless otherwise specified, the rights granted under these terms are granted solely to the individual who signed the order (or the person holding the email address provided). In accordance with the legal provisions relating to conformity and hidden defects, the Seller will refund or exchange products that are defective or do not correspond to the order. Upon receipt of your parcel, you have 14 days to return your items to us. The products must be returned new, repackaged in their original condition (not wrinkled, folded, etc.), with their label and in their original packaging (box, tissue paper, plastic pouch). A non-compliant return will not be accepted and will be sent back to you.

Article 6: Retention of title The products remain the property of the Company until the price has been paid in full.
Article 7: Delivery terms The products are delivered to the delivery address indicated when the order was placed and within the stated timeframe. This timeframe does not include the order preparation time. When the Customer orders several products at the same time, they may have different delivery times. In the event of a shipping delay, the Customer must contact La Piece's customer service through the contact form. In the event of a delivery delay, the Customer may terminate the contract under the conditions and procedures defined in Article L 138-2 of the Consumer Code. The Seller will then refund the product and the “outbound” shipping costs under the conditions of Article L 138-3 of the Consumer Code. The Seller provides a telephone contact point (the cost of a local call from a landline) indicated in the order confirmation email to ensure order tracking. The Seller reminds the Customer that, when the Customer physically takes possession of the products, the risks of loss or damage to the products are transferred to the Customer. The Customer is responsible for notifying the carrier of any reservations concerning the delivered product.
Article 8: Availability and presentation Orders will be processed subject to the limits of our available stock or subject to stock availability from our suppliers. If an item is unavailable for more than 15 business days, you will be immediately informed of the foreseeable delivery times and the order for that item may be canceled upon simple request. The Customer may then request a credit for the amount of the item or a refund.
Article 9: Payment Payment is due immediately when the order is placed, including for pre-ordered products. The Customer may pay by payment card or bank check. Cards issued by banks domiciled outside France must be international bank cards (Mastercard or Visa). Secure online payment by bank card is processed by our payment service provider. The information transmitted is encrypted in accordance with industry standards and cannot be read while being transmitted over the network. Once payment has been initiated by the Customer, the transaction is immediately debited after the information has been verified. In accordance with the provisions of the Monetary and Financial Code, the commitment to pay made by card is irrevocable. By providing their bank details during the sale, the Customer authorizes the Seller to debit their card for the amount of the stated price. The Customer confirms that they are the legal holder of the card to be debited and are legally entitled to use it. In the event of an error or if the card cannot be debited, the Sale is immediately terminated by operation of law and the order canceled.
Article 10: Withdrawal period In accordance with Article L. 121-20 of the Consumer Code, “the consumer has a period of fourteen clear days in which to exercise their right of withdrawal without having to give reasons or pay penalties, with the exception, where applicable, of return costs”. “The period referred to in the preceding paragraph begins on receipt in the case of goods or acceptance of the offer in the case of services”. We inform Customers that, in accordance with Article L. 121-20-2 of the Consumer Code, this right of withdrawal cannot be exercised for custom-made products. If the right of withdrawal is exercised within the aforementioned period, only the price of the product or products purchased and the shipping costs will be refunded; return costs remain the responsibility of the Customer. Products must be returned in their original and complete condition (packaging, accessories, instructions, etc.) so that they can be resold as new; where possible, they should be accompanied by a copy of the proof of purchase. Article 11: Warranties In accordance with the law, the Seller provides two warranties: conformity and hidden defects in the products. The Seller will refund the Buyer or exchange products that appear to be defective or do not correspond to the order placed. A refund request must be made as follows:

Article 12: Complaints Where applicable, the Buyer may submit any complaint by contacting the Company via the contact form on the website homepage.
Article 13: Intellectual property rights Trademarks, domain names, products, software, images, videos, texts or, more generally, any information subject to intellectual property rights are and remain the exclusive property of the Seller. No transfer of intellectual property rights is made under these GTCS. Any reproduction, in whole or in part, modification or use of these assets for any reason whatsoever is strictly prohibited.
Article 14: Force majeure The performance of the Seller's obligations under these terms shall be suspended in the event of an unforeseeable event or force majeure that prevents performance. The Seller shall inform the Customer of the occurrence of such an event as soon as possible.
Article 15: Severability and modification of the contract If any provision of this contract is canceled, such cancellation shall not result in the cancellation of the other provisions, which shall remain in force between the parties. Any contractual amendment is valid only after a written agreement signed by the parties.
Article 16: Protection of personal data In accordance with the French Data Protection Act of 6 January 1978, you have the right to inquire about, access, modify, object to the processing of and rectify personal data concerning you. By accepting these General Terms and Conditions of Sale, you consent to our collecting and using this data for the performance of this contract. By entering your email address on one of the websites in our network, you will receive emails containing information and promotional offers concerning products published by the Company and its partners. You may unsubscribe at any time. To do so, simply click on the link at the end of our emails or contact the data controller (the Company) by registered letter with acknowledgment of receipt. We monitor visitor traffic across all our websites. For this purpose, we use tools such as Google Analytics
Article 17: Applicable law All clauses set out in these General Terms and Conditions of Sale, as well as all purchase and sale transactions referred to herein, shall be governed by French law.

If you pay for your order in installments, you accept Alma's customer general terms and conditions. as well as Alma's special terms and conditions for customers of Atelier Visconti.
